Intimidation Charge Dismissed & Apprehended Domestic Violence Order Removed

Jack Leitner represented a 42 year old male at Sutherland Local Court in respect of a charge of Stalk/Intimidate Intend to Cause Fear and in relation to an application for an Apprehended Domestic Violence Order brought against him by Police.

Our client had pleaded not guilty to the charge and contested the application for an Apprehended Domestic Violence Order against him. We thoroughly prepared our client’s case and conducted a comprehensive cross-examination of the complainant as well as other witnesses in the case. Through our meticulous advocacy and cross-examination, we were able to highlight the inherent implausibility of various aspects of the complainant’s account such that the Magistrate ultimately concluded that large parts of the complainant’s evidence defied belief and that the victim could not be accepted as being a witness of truth.

The Judgment

After a lengthy judgment, the Magistrate was not satisfied that the charge of Stalk/Intimidate was proved beyond reasonable doubt and the charge against our client was dismissed. Similarly, based on the evidence, the Magistrate was also not satisfied on the balance of probabilities that the grounds for an Apprehended Domestic Violence Order against our client were established and this application was also dismissed.
